This privacy statement discloses the privacy practices for Patron Loyalty, a loyalty program service. Because maintaining the trust of our customers is a priority for us, Patron Loyalty is committed to respecting your privacy.

The following Privacy Statement provides details about how your personal information is collected and used. This privacy statement applies to the Patron Loyalty website, customer web portals, software products and services that are located in, but not limited to the patronloyalty.com domain, as well as SMS and e-mail communications delivered in conjuction with participation in the program.

From time to time, Patron Loyalty may introduce new products and services. To the extent that these new products and services affect this policy, this policy will be updated. Please see item number 2 for more details.

WHAT INFORMATION IS COLLECTED

We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. Patron Loyalty collects information provided by program participants, including but not limited to name, age, email and phone number. Information collected is available only to the specific merchant(s) you share your information with, as well as Patron Loyalty staff, as the program admistrator.

Participation and enrollment in the loyalty program requires users to give contact information (such as name, phone and email address) for use with the loyalty program. Information collected is not used for any purpose outside of the loyalty program.

We also keep track of activity on our website via log files stored on our web servers. We collect information, including but not limited to, date of visit, IP address, browser type and version. We use our logs of your activity to diagnose problems with our server and to administer our program.

WHAT IS PATRON LOYALTY™?

Patron Loyalty is a general name used to describe the loyalty program we provide. The company's Patron Loyalty™ technology enables participating merchants to sell and process gift cards and to implement an effective loyalty marketing program. The Patron Loyalty™ program includes a customer accessible Web Portal, which you can use to enroll in a merchant's specific loyalty program, to access up-to-date information regarding your loyalty program status, to keep your personal information current and to revise your email, sms and directmail participation preferences at any time, 24x7.

WHAT INFORMATION IS TRACKED AND HOW IS IT USED?

You may be asked to provide certain personal information to our merchants, in connection with your use of the Patron Loyalty™ program, such as when you enroll in the program. If you choose to provide personal information to a participating merchant, you should review the individual privacy policy of that merchant, often found on the merchant's website. Patron Loyalty is not responsible for the privacy practices of participating merchants.

MEMBER PROFILE INFORMATION: The Patron Loyalty™ system tracks member enrollment information, including name, address, phone and email address, throughout our software, site and merchant Web portals. Our system also track incoming IP addresses and workstation names which access our data center and site.

TRANSACTION INFORMATION: The Patron Loyalty™ system tracks sales transactions, including sales amounts, points earned, gift card deductions and balances and gift card account numbers. Our programs do not track or store any credit card information.

COOKIES: A cookie is a small data file that some Web sites write to your hard drive when you visit the sites. We may track encrypted account access information, in the form of cookies, when accessing the Member Portal or Message Center. Additionally, your browser, may track information on your computer in the form of cookies for the purpose of caching pages for faster access in the future. You can adjust this behavior by customizing your browser properties and settings.

EMAILS AND SMS TEXT: Personal information that you provide to merchants may be used to communicate to you, via EMAIL or SMS Text. Receipt of this information is controlled via an opt-in/opt-out preference stored against your loyalty account. If you are not receiving the communcations and would like to, you may choose to change your preferences by accessing your loyalty account via the online Web Portal or by contacting the specific merchant with whom you want to receive communications from. If you are receiving Email communications and no longer wish to, you can opt-out by clicking the one-click unsubscribe link found in every email that leaves our system. The unsubscribe link is an automated way for you to immediately cease receiving email from our system. If you are not receiving SMS Text communications and would like to, simply text to the participating merchant's mobile number, supplying the merchants keyword as a prefix, followed by a space, then YES. If you are receiving SMS text messages from our system and no longer wish to, you may opt-out immediately by replying STOP to any message you receive. Opt-out is immediate in all cases.

Personal information, inclusive of email address, email opt-in, mobile number and mobile/sms opt-in, is never shared with anyone other than the participating merchants for which consent has been given. For SMS messages sent to you from the loyalty program, message and date rates may apply.

WEB BEACONS: All emails distributed through our system contain electronic images known as web beacons, also known as single-pixel GIFs, which are invisible graphical images. These web beacons allow us to count users who have opened email delivered from our system and who have visited associated web pages or ads provided as links in those emails. Web beacons collect only limited information, such as the date/time the email was opened and who opened it. Web Beacons can be refused. If you do not wish to receive Web Beacons via email, you will need to disable HTML images or refuse HTML (select Text only) emails via your email viewer software.

CHOICE/OPT-OUT: Patron Loyalty adhers to an industry standard Anti-Spam Policy and, as such, we tolerate only permission-based email and SMS Text messaging. Recipients always have the opportunity to opt-out via a one-click unsubscribe link in the footer of all email messages or by replying STOP to any SMS Text message. Additionally, these options are made available when you sign-up for enrollment in the loyalty portal. If you believe that you have received an unsolicited email or SMS text from Patron Loyalty, you may report it to us at help@patronloyalty.

CONFIDENTIALITY OF CONTENT: When email or SMs is delivered from our system, it is routed from server to server as it navigates it's path through the Internet. During these travels server administrators and support personnel can read what is sent. Email and SMS are not the forum for delivery of confidential information. As such, never send anything in an email or SMS that shouldn't be subject to public display. If you have confidential information to communicate, do not use Patron Loyalty delivery systems!

ANTI-SPAM POLICY ENFORCEMENT: We regularly review the content of all Email and SMS Campaigns that leave our system to verify compliance with TCPA and Anti-Spam policies and with our Terms of Use. We work hard to maintain a solid reputation with the various gateway providers in the industry and will not tolerate any misuse of our systems, which could tarnish our reputation. Any merchant's found to be abusing these policies are subject to immediate suspension from using our systems until such time an investigation can be completed.

OWNERSHIP OF INFORMATION: All information collected is the sole property of the merchant you chose share it with, who collected the information from their version of the loyalty portal and electronically transmitted that information to our data center for management and storage of. We may access said information, from time to time, for the sole purpose of supporting and or training employees of the subscribing merchant. We DO NOT sell, share or provide access to any member or transaction related information, inclusive of email and mobile numbers, collected by a subscribing merchant.

This privacy policy is subject to change at the sole discretion of Patron Loyalty. When we modify the privacy policy, we will post the changes in a revised policy statement. You are responsible for regularly reviewing the Patron Loyalty privacy policy to obtain timely notice of such revisions.

WITH WHOM IS INFORMATION SHARED?

We will never voluntarily share personally identifiable information about any particpating member or participating merchant or any information collected by a participating merchant with any third party without the party's express consent or unless compelled by applicable state and federal laws. Please refer to your merchant's specific Privacy Policy for details regarding their policy on sharing of data they collect through our service.

Patron Loyalty uses industry standard protocols to safeguard the confidentiality of personally identifiable information, including secure sockets layer (SSL) encryption and firewalls. Data is also subject to industry standard backup practices and maintained at our secured data center. Nevertheless, we remind you that no security measure is perfect.
